Lawsuit over Cow Manure

An action some might see as a childish prank has resulted in legal action in Des Moines County.

Mary Eipert and Steven Rowland filed a lawsuit Feb. 9 against their neighbors, Kimberly and Carlos Capdevila, in District Court.

In it, they claim Kimberly Capdevila harassed them by mailing a bag of cow manure to their home.

Capdevila said it was a prank, but she was arrested and charged with 3rd degree harassment.  A pretrial conference is set for early April.

Eipert and Rowland are seeking damages for that and because they claim Capdevila encouraged others to mail cow manure to the two as well, which some did.

They also want the court to force the Capdevilas to do something about their dog, which they claim barks all day and night. Eipert and Rowland are seeking damages related to the constant barking for past, present and future pain & suffering and medical expenses.
