The City of Macomb is saying little about the disputed election in the city’s second ward. Mayor Mike Inman read a brief statement during the city council meeting on Monday."The city attorney informed me last Thursday that both the city and the county had been contacted by legal representatives from Mr. Wailand and since that correspondence has been received we do not want to do anything that would impede discussions that are occurring between Mr. Wailand's Legal Representatives, the city and the county and we will await the outcome of those discussions, thank you," Inman said.
Candidate Steve Wailand said the non-profit Liberty Justice Center will represent him in the matter. He also said that the Center intended to file a legal writ to compel the city and county clerk’s office to “do their statutory duty.”
Wailand received 17 votes to incumbent Kay Hill’s 16 during the city’s February election. But the County Clerk declined to declare Wailand the winner, saying that he needed to get 50 percent of the vote plus one.

As a result of her ruling, there will be a run-off election in a couple weeks. The 50-percent plus one rule does not appear in Macomb’s city code.
In his statement Monday evening, Inman said the city clerk acted appropriately.
